Terms of Use

These terms govern use of the Waterguard website and the information, tools, and request forms available through it.

Using this site

These terms are between you and Waterguard LLC ("Waterguard," "we," or "us"). By using this site, you agree to these terms. If you do not agree, do not use the site. Waterguard may update these terms as the site, products, and business practices change.

General information—not project approval

Website content is provided for general product information, preliminary selection, and project coordination. It is not architectural, engineering, legal, code, inspection, or authority-having-jurisdiction approval, and it does not replace the judgment of the project’s licensed professionals.

Project teams remain responsible for confirming adopted codes, specifications, wall requirements, substrates, joint conditions, sequencing, compatibility, installation, inspection, and acceptance for the actual construction.

Technical claims, tests, and listings

Test results, performance statements, and listed-assembly references apply only to the exact construction, conditions, limitations, and procedures identified in the current supporting report, listing, product data, and installation instructions. They must not be extended to a different wall, joint, substrate, dimension, movement condition, or installation.

Waterguard FS may be selected or substituted for a fire-rated condition only when a current applicable listed assembly has been identified and every condition of that assembly is satisfied. If website content differs from a current official technical document or listing, the current official document controls.

Quotes, samples, availability, and transactions

Website requests, preliminary quantities, availability statements, and responses are not binding offers or acceptances. Pricing, lead times, freight, taxes, fulfillment, warranties, returns, and other transaction terms are governed by the applicable written quote, order acknowledgment, distributor terms, or sales agreement.

Limited product warranty

The Waterguard limited express warranty states the product warranty and its limitations. General descriptions elsewhere on this site do not expand it or guarantee a particular project result. Applicable written transaction terms also govern the purchase.

Messages and uploaded files

If you submit a message or upload project files, you represent that you are authorized to share the information and that Waterguard may review, store, reproduce internally, and share it with service providers or request partners as reasonably necessary to respond to your request.

Do not upload material that infringes another person’s rights, violates a confidentiality obligation, contains malware, or is unlawful. Submission does not create a confidential, fiduciary, design-professional, or other special relationship unless Waterguard agrees otherwise in writing.

Project references and third-party names

Project names, owners, architects, contractors, distributors, photographs, logos, and other third-party names or marks are used to identify reported projects, participants, or purchasing paths. Unless expressly stated, their appearance does not imply sponsorship, endorsement, certification, partnership, or affiliation with Waterguard.

Intellectual property

Website text, graphics, product imagery, logos, page designs, downloads, and other content are owned by Waterguard or used with permission and are protected by applicable intellectual-property laws. You may view and download materials for legitimate evaluation of Waterguard products, but you may not republish, modify, sell, or use site content for another commercial purpose without permission.

Privacy

The Privacy Policy explains how information submitted through or collected by the site is handled.
